1. Agreement to Terms

By accessing or using DiscountOffers.com.au (“the Site”, “we”, “us”, “our”) you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our Site.

DiscountOffers.com.au is operated by a sole trader registered in Australia:

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

2. Description of Service

DiscountOffers.com.au is an Australian deal intelligence platform providing:

  • Verified deal listings sourced from Australian retailers
  • Deal Truth Scores — a proprietary rating system (1–10) based on historical Australian price data
  • Price comparison information across Australian retailers
  • A weekly deals newsletter delivered every Thursday
  • Price drop alert notifications for registered users
  • Merchant featured placement services for Australian retailers
  • A wishlist and saved deals feature for registered users

Our service is free to Australian consumers. We earn revenue through affiliate commissions and merchant featured placement fees. See our Affiliate Disclosure for full details.

3. Deal Truth Score — Scope and Limitations

Our Deal Truth Score is calculated from historical price data we collect and verify. You acknowledge that:

  • Historical price data is not guaranteed to be complete or error-free
  • A high Deal Truth Score is not a guarantee of the lowest price available anywhere in Australia
  • Future prices may not align with historical trends
  • Price data sourced from third parties may contain inaccuracies

The Deal Truth Score is an informational guide only and must not be the sole basis for any purchasing decision. We accept no liability for purchasing decisions made based on Deal Truth Score ratings. Nothing in this clause limits your rights under the Australian Consumer Law.

4. Affiliate Relationship Disclosure

We participate in affiliate marketing programs. When you click a deal link and make a qualifying purchase, we may earn a commission paid by the retailer. This costs you nothing extra. Our affiliate relationships do not influence our Deal Truth Score ratings.

5. Accuracy of Deal Information

We make every reasonable effort to ensure deal information is accurate at the time of publication. However:

  • Prices and availability are subject to change without notice by the retailer
  • We cannot guarantee any deal is still available when you click the link
  • Discrepancies may exist between prices shown on our site and prices at checkout
  • Deals may expire or be withdrawn by retailers at any time
  • We are not responsible for errors in retailer pricing systems

We recommend verifying the final price at the retailer’s website before completing any purchase.

6. Pricing and GST (Merchant Services)

All merchant featured placement fees displayed on our pricing page are stated in Australian dollars and include GST where indicated.

  • GST at 10% is included in all prices marked “inc. GST”
  • Tax invoices are issued upon request to merchants@discountoffers.com.au
  • Payment is processed via Stripe and is subject to Stripe’s Terms of Service
  • Subscription fees are charged monthly in advance
  • Featured placement fees are non-refundable once the placement period has commenced
  • Month-to-month plans may be cancelled at any time; cancellation takes effect at the end of the current billing period
  • We reserve the right to change our pricing with 30 days written notice to active subscribers

7. User Accounts

When you create an account:

  • You must provide accurate and complete information
  • You must be at least 18 years of age
  • You are responsible for maintaining the security of your password
  • You must notify us immediately of any unauthorised account access at hello@discountoffers.com.au
  • You may not create accounts on behalf of others without their express permission
  • You may not create multiple accounts for the purpose of circumventing restrictions
  • We reserve the right to suspend or terminate accounts that violate these Terms, with notice where practicable

8. User Generated Content

Registered users and merchant partners may submit content including deal listings, images, and descriptions. By submitting content you:

  • Warrant that you own it or have the right to submit it
  • Warrant that it is accurate and not misleading under Australian Consumer Law section 18
  • Warrant that it does not infringe any third party intellectual property rights
  • Grant DiscountOffers a non-exclusive, royalty-free, worldwide licence to display it on our platform
  • Acknowledge that we may edit, moderate, or remove content at our discretion without notice
  • Acknowledge that we are not responsible for inaccuracies in merchant-submitted content

9. Merchant Obligations

Australian retailers using our platform agree that:

  • All deals submitted must be genuine and accurately priced
  • Inflated “was” prices designed to create misleading discount percentages are prohibited under ACL section 18 (misleading or deceptive conduct) and section 29 (false representations)
  • The ACCC requires that a “was” price must have been a genuine price at which the product was offered for a reasonable period before the sale
  • Merchants may not instruct us to alter, suppress, or remove Deal Truth Scores
  • Merchants are responsible for ensuring submitted deals comply with all applicable Australian laws

Merchants who submit misleading deals may have their content removed and access suspended without refund.

10. Prohibited Activities

You must not:

  • Submit false, misleading, or inaccurate deal information
  • Use the site for any purpose prohibited by Australian law
  • Attempt to manipulate Deal Truth Score calculations
  • Scrape or systematically copy our price history data without written permission
  • Attempt to access system areas you are not authorised to access
  • Use automated tools to bulk-submit deals or create accounts
  • Impersonate any person or organisation
  • Submit content that infringes any intellectual property rights
  • Engage in conduct that is threatening, harassing, or abusive towards our team

11. Intellectual Property

All content on DiscountOffers.com.au — including the Deal Truth Score name, methodology, site design, written content, and data compilations — is owned by DiscountOffers and is protected under the Copyright Act 1968 (Cth) and other applicable Australian intellectual property laws.

You may not copy, reproduce, distribute, or commercially exploit our content without prior written permission. Third party trademarks and retailer names remain the property of their respective owners.

12. Third Party Websites

Our site contains links to third party retailer websites. We are not responsible for:

  • The content, accuracy, availability, or privacy practices of third party websites
  • Any transactions you complete on third party websites
  • Any disputes between you and a retailer
  • Losses arising from your use of or reliance on third party websites

Your use of third party websites is solely governed by their own terms and conditions.

13. Limitation of Liability

To the maximum extent permitted by Australian law, DiscountOffers shall not be liable for:

  • Purchasing decisions based on Deal Truth Scores
  • Price discrepancies between our site and retailer websites
  • Loss of savings if a deal expires before you access it
  • Indirect, incidental, special, or consequential loss or damage
  • Technical errors, downtime, or data inaccuracies

Where our liability cannot be excluded under law, our total liability is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 AUD.

14. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2 of the *Competition and Consumer Act 2010* (Cth)) that cannot be lawfully excluded.

The services we provide to consumers come with guarantees that cannot be excluded under the ACL, including that services will be provided with due care and skill. Where the ACL applies and a remedy is required, our liability is limited to the extent permitted under section 64A of the ACL.

15. Spam Act Compliance

By subscribing to our newsletter or enabling price alerts, you consent to receive commercial electronic messages from us in accordance with the Spam Act 2003 (Cth).

You may unsubscribe at any time by clicking the unsubscribe link in any email or by emailing hello@discountoffers.com.au. We will action all unsubscribe requests within 2 business days of receipt.

16. Dispute Resolution

If you have a dispute, please contact us first at hello@discountoffers.com.au (subject: “Dispute”) and allow 14 days for informal resolution before commencing formal proceedings. This does not affect your right to contact the ACCC, OAIC, or any court for urgent relief.

For unresolved consumer disputes:

  • ACCC: accc.gov.au or 1300 302 502
  • NSW Fair Trading: fairtrading.nsw.gov.au or 13 32 20

17. Changes to Terms

We may update these Terms at any time. We will notify registered users of material changes via email with at least 14 days notice before the change takes effect. Continued use after the effective date constitutes acceptance.

18. Termination

We may suspend or terminate access if you breach these Terms. You may close your account at any time by contacting hello@discountoffers.com.au.

19. Severability and Entire Agreement

If any provision is found unenforceable, the remaining provisions continue in full force. These Terms, together with our Privacy Policy, Cookie Policy, and Affiliate Disclosure, constitute the entire agreement between you and DiscountOffers.
